In December 2016, the City of Denver released a new rule: As the city enters into a new contract for building new businesses that will be open to commercial use, Denver City Councilors voted to make the new $5,000 fine a requirement. The fine had been issued in 2017 and has yet to go away, but the announcement by Mayor John Hickenlooper and council members said the city still expects to pay a $10m fine by May 2018.
In 2017, the fines had been added on to their 2018 and 2017 city contracts for new construction, a process which will begin once construction on the new tower is completed. In October, $5,000 was set aside for council members to take into account a new $5,000 fine for an earlier announcement, a rule enacted last September, that also mandated that "a $5,000 fine is made in 2017 if a business fails to pay a $1,000 fine by the end of the year". The fines are not related to the construction site redevelopment, which was slated to commence from 2019.
